Online Purchases
When you place an order for a product on our website, we will send you an email confirming receipt of your order. We accept an order when the product is paid for to you. We will send you an email confirming payment for the product (the "Order Confirmation"). At this point, a separate agreement for the purchase of the product will come into being between you and the Company, binding upon you and us (the "Contract"). If we are unable to supply the product to you, we will notify you in writing and will not process the order.
Fulfillment and Delivery of All Orders Placed on the Website. We expressly reserve the right not to accept your order for any reason. We still reserve the right to cancel the contract by notifying you in writing by email in the following circumstances, without us receiving any damages or costs other than refunding any monies you have accrued in respect of our cancellation:
The product is unavailable or out of stock;
The stock product is damaged or does not meet our quality standards;
Your billing information is incorrect, unverified or cannot be verified;
Your order is flagged by our security system as an unusual order or a vulnerable order;
We have reason to believe that you are under the factory age for a renovation contract;
We have reason to believe that you are a dealer, distributor or employee;
There is an error in the price displayed on the website;
We are unable to deliver the goods to the shipping address you provide;
Due to events beyond our control (see below);
If there are spelling errors, pricing errors or other errors in the information;
When you provide false, incorrect or incomplete information (including but not limited to delivery address, telephone number, email address, etc.), it may result in unsuccessful delivery or contact with you.
We will ask you for payment information when ordering. You can find the available payment methods at checkout. We (or our service providers) may check your information before completing the order. These checks may include verifying your address and checking for fraud.
The estimated delivery time and shipping costs for each order may be displayed to you at checkout or in the Shipping Policy. While we make every effort to deliver goods (or have third party carriers deliver goods) within the estimated time, delays may occasionally occur. The Company is not responsible for any delay or failure to deliver goods within the estimated time.
Title and risk of loss for products purchased through the Website pass to you upon our delivery to the carrier (unless local law in your location requires a different result). Title to the products does not pass until full payment has been received.
Events beyond our control
An event beyond our control means any act or event beyond our reasonable control, including but not limited to strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster, or failure of public or private telecommunications networks.
If an Event Beyond Our Control occurs that affects our ability to perform our obligations under these Terms of Sale:
a) we will contact you as soon as possible to let you know; and
b) our obligations under these General Conditions will be suspended and the time to perform our obligations will be extended for the duration of the Event Beyond Our Control unless we are able to mitigate the consequences of that Event.
If an Event Beyond Our Control affects our ability to deliver the Products to you, we will arrange a new delivery date with you once the Event Beyond Our Control has ended or when we can mitigate the effects of the Event. If an Event Beyond Our Control occurs and you no longer wish us to supply the Products, you may cancel the Contract.
